PUBLIC COMMENT PERIOD and PUBLIC HEARING for the:
Community Development Block Grant (CDBG) Program
CONSOLIDATED ANNUAL PERFORMANCE
AND EVALUATION REPORT
PUBLIC COMMENT PERIOD
Notice is hereby given that the City of Des Plaines’ Consolidated
Annual Performance and Evaluation Report (CAPER) for Program Year
2008 will be available for public review and comment beginning
Friday, November 20, 2009. The CAPER is the City’s annual report to
the U.S. Department of Housing and Urban Development (HUD)
concerning activities using CDBG funds. Program Year 2008 began
October 1, 2008 and ended September 30, 2009.
The City of Des Plaines invites comments on the CAPER. The
required 15-day public comment period will begin Friday, November
20, 2009 and end Monday, December 7, 2009. The document will be
available by visiting or contacting the Community and Economic

PUBLIC HEARING
A public hearing on the CAPER will be held during the regularly
scheduled City Council meeting on December 7, 2009. The public
hearing will begin at 7:00 pm in Room 102 of the Des Plaines Civic
Center, 1420 Miner Street, Des Plaines, IL 60016. The CAPER will be
submitted, along with citizen comments to HUD after the hearing.

Written comments can be sent to the attention of the CDBG
Coordinator at the same location and will receive a written response
within 15 days of receipt. Citizens will also have the opportunity
to present oral comments at the Public Hearing described below.

Environmental Review Record (ERR)
These Notices shall satisfy two separate but related procedural
requirements for activities to be undertaken by the City of Des
Plaines.
REQUEST FOR RELEASE OF FUNDS
On or about November 4, 2009 the City of Des Plaines will submit
a request to the HUD Chicago Field Office for the release of PY2008
CDBG-R and PY2009 CDBG Program funds under Title I of the Housing
and Community Development Act of 1974, as amended, to undertake a
project known as the Infrastructure Improvement Program, for the
purpose of installing water pipes for fire hydrants at 815 E. Oakton
St. The estimated funding for the project is $287,029.00.
FINDING OF NO SIGNIFICANT IMPACT
The City of Des Plaines has determined that the project will have
no significant impact on the human environment. Therefore, an
Environmental Impact Statement under the National Environmental
Policy Act (NEPA) of 1969 is not required. Additional project
information is contained in the Environmental Review Record (ERR) on
file at Des Plaines City Hall, 1420 Miner St., Department of
Community and Economic Development and may be examined or copied
weekdays 8:30 am to 5:00 pm.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this
determination or wishing to comment on the project may submit
written comments to Chan Yu, Associate Planner, Department of
Community and Economic Development, 1420 Miner St., Des Plaines IL.,
60016. All comments received by November 3, 2009 will be considered
by the City of Des Plaines prior to submission of a request for
release of funds. Comments should specify which Notice they are
addressing.
RELEASE OF FUNDS
The City of Des Plaines certifies to HUD/Chicago Field Office
that Jon Duddles in his capacity as Assistant Director of Public
Works and Engineering consents to accept the jurisdiction of the
Federal Courts if an action is brought to enforce responsibilities
in relation to the environmental review process and that these
responsibilities have been satisfied. HUD'S/ Chicago Field Office's
acceptance of the certification satisfies its responsibilities under
NEPA and allows the City of Des Plaines to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/Chicago Field Office will accept objections to its release of
funds and the City of Des Plaines certification for a period of
fifteen days following the anticipated submission date or its actual
receipt of the request (whichever is later) only if it is on one of
the following bases: (a) the certification was not executed by the
Certifying Officer of the City of Des Plaines; (b) the (RE) has
omitted a step or failed to make a decision or finding required by
HUD regulations at 24 CFR Part 58; (c) the grant recipient has
incurred costs not authorized by 24 CFR Part 58 before approval of a
release of funds by HUD/Chicago Field Office; or (d) another Federal
agency acting pursuant to 40 CFR Part 1504 has submitted a written
finding that the project is unsatisfactory from the standpoint of
environmental quality. Objections must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58) and shall
be addressed to the Director of CPD at the HUD/Chicago Field Office
at 77 W. Jackson Blvd., Room #2401, Chicago, IL 60604-3507.
Potential objectors should contact HUD/Chicago Field Office to
verify the actual last day of the objection period.
